- COVID-19 Essential Worker Status: In 2020, GAR played a key role in having real estate deemed critical infrastructure and REALTORS® classified as essential workers, keeping your business open when it mattered most.
- Local Government Marketing Rights: Passed legislation allowing local governments to hire a REALTOR® to market real property — opening up valuable new business opportunities for members.
- TRID Compliance Protection: Brought Georgia Real Estate License Law into compliance with the TILA-RESPA Integrated Disclosure Rule, safeguarding members from unnecessary legal exposure.
- Freeport Exemptions for E-Commerce: Supported expansion of Freeport Exemptions to include e-commerce facilities, benefiting commercial members and strengthening Georgia’s competitive economic edge.
- Special Stipulations Defended: Protected REALTORS®’ ability to write special stipulations and provide clients with guidance during contract completion — preserving a critical value-add you provide every day.
- Appraiser Appeals: Passed legislation allowing appraisers to appeal at the state level when not fairly compensated by an Appraisal Management Company — supporting fair standards across the industry.
- Expanded Trust Account Options: Expanded the types of permissible accounts for real estate trust funds, giving brokers greater flexibility in how they manage client funds.
- Blocked New Criminal Penalties: Prevented legislation that would have created new criminal penalties for hindering code enforcement officers — protecting members from disproportionate legal risk.
- Auction Licensing Requirement Defeated: Stopped legislation that would have required REALTORS® selling property via competitive, sealed, or silent bid to obtain an auctioneer’s license in Georgia.
- Short Sale Transactions Legalized: Passed legislation formally allowing REALTORS® to engage in short sale transactions, which had previously been interpreted as illegal by the Georgia Banking Department.
- Escrow Rights Protected: Secured REALTORS®’ right to collect and distribute escrow funds — a fundamental protection for everyday real estate transactions.
- MLS Disclosure Liability Shield: Amended real estate license law disclosure requirements after members were sued for not disclosing MLS fees — protecting you from burdensome and unfair legal liability.
- Independent Contractor Insurance Pooling: Passed legislation allowing independent contractors to pool together for insurance purposes — helping agents access better, more affordable coverage.
- AMC Regulation Passed: Established regulation of Appraisal Management Companies, bringing accountability and fairness to an area of the industry that directly affects your transactions.
- Multi-Jurisdiction Business License Fees Blocked: Prevented cities and counties from charging individual agents a separate business license fee for every jurisdiction where they conduct business.
- 6% Sales Tax on Commissions Defeated: Blocked a proposed 6% state sales tax on real estate commissions — a significant win that directly protected your take-home income.
- Workers’ Comp Protection for Brokers: Prevented legislation that would have required real estate brokers to pay workers’ compensation for individual agents, protecting the independent contractor model our industry depends on.
